Employer Requirements
To sponsor a skilled worker under Subclass 494, employers must meet the following criteria:
- Operate in a designated regional area of Australia.
Regions include Adelaide, Canberra, Gold Coast, Geelong, Perth, and Sunshine Coast. Other areas such as Wollongong, Newcastle, and New South Wales Central Coast are also expected to be classified as regional soon. - The nominated position must be listed on the relevant skilled occupation list, which currently includes over 700 occupations.
- Secure approval from the Regional Certifying Body (RCB) in their region before nominating a candidate.
- Ensure the job is genuine, full-time, and available for a minimum of five years.
- Offer a market-rate salary in line with industry standards.
Eligibility Criteria for Skilled Workers
Applicants must meet the following requirements:
- Hold a positive skills assessment for the nominated occupation.
- Have at least 3 years of relevant full-time work experience.
- Be under 45 years of age at the time of application.
- Demonstrate Competent English proficiency (typically IELTS 6 or equivalent in each band).
Pathway to Permanent Residency – Subclass 191
Although Subclass 494 is a provisional visa, it is a stepping stone to permanent residency via the Permanent Residence (Skilled Regional) Visa – Subclass 191. To qualify for the 191 visa, applicants must:
- Have held the Subclass 494 visa for at least three years.
- Have lived and worked in a designated regional area during this time.
- Submit proof of meeting the minimum annual income requirement for three consecutive years.
- If applying as a couple, only one partner needs to be the primary applicant for the Subclass 191 visa, but both must meet the income threshold.
